At the outset and on behalf of staff members of our association in PCDA (Navy), Mumbai, CDA (CSD) appreciates the work done for the welfare of members.
However, it is a long held view the results of the erstwhile examination for  MTS held on 18.09.2012 for promotion to the grade of LDC has not been declared. The results in dissatisfaction among the MTS and the same leads demoralization.
Hence it is requested to take up the matter with CGDA and do the needful for our members.

AIDAEA (HQ) Kolkata is in a view that MTS (erstwhile Group-D) are mostly deprived of their promotion and worst sufferer of the Department. Accordingly, AIDAEA (HQ) consistently pursuing the matter with CGDA in IIIrd level JCM at HQr regarding their promotion since 2004. A chronological information that the matter of Group D promotion had been raised in IIIrd level JCMs at CGDA by AIDAEA (HQ) Kolkata are shown below.

Meanwhile, owing to organisational turmoil we could not table the matter at the level of CGDA since we were out of JCM.  After having JCM rights the present Secretary General on assumption of charges in 2010 started dialogue with the CGDA on the MTS issues. Some are solved. Some are yet to be solved.  AIDAEA (HQ) Kolkata is constantly raising voice for departmental upliftment of the MTS.  A chronological information of our agenda in JCM IIIrd levels are given hereunder :-

38 SCM/30.03.2010    - Departmental Examination to qualify Group-D to Clerk grade.
39 SCM/21.02.2011   - Promotion of Group D to Clerk
40 SCM/26.09.2011   - Promotion  of MTS to Clerk irrespective of qualification.
42 MM/29.01.2013     - All RC to be promoted to the grade of Clerk.
43 SCM/30.05.2013   - ACP benefits to Group D be given immediately.

I m quite optimistic of an early solution of the issue.
We also incorporated the MTS issue in the Charter of Demands and served 12th & 13th February 2014 Strike notice to the CGDA. I beg your active support in ensuing all India Strike of Central Govt. Employees.

Subject: Grant of 1st and 2nd ACP to erstwhile Group ‘D’ Employees, now designated as MTS.

In the JCM III council meeting held in Ordnance Factory Board (OFB) on 7.6.13 the staff side expressed their resentment for not considering extension of the benefit of financial up gradation under ACP scheme to the erstwhile Group ‘D’ employees who have been designated Multi-Tasking staff w.e.f 1.1.2006. The case was referred to this office for offering comments on extension of the benefit before issue of executive orders by the OFB authority.
Accordingly the case has been examined and following views are submitted for perusal of the HQrs Office.
1.It may be mentioned that the erstwhile Group ‘D’ employees who have been designated as MTS w.e.f. 01-01-2006 were initially appointed in pre-revised pay scale of Rs.2550-55-2600-60-3200 and subsequently got either promotion or ACP up-gradations up-to the pay scale of Rs. 2750-70-3800-75-4400. After 6 CPC all the scales from Rs.2550-3200 up to Rs.2750-4400 have been merged in pay band-1 with grade pay of Rs. 1800. Hence. As per provisions contained in clarification no.1 issued by DOPT on ACP scheme vide no. 35034/1/97-Estt(D)(Vol-IV) dated 10.02.2000 such movements in between merged pay scales of Rs.2550-3200/- to Rs.2750-4400/- should be ignored for the purpose of ACP up-gradation. Therefore, these employees who have completed 24 years of regular services prior to 1.9.2008 deserves consideration of 1st and 2nd ACP up gradation since due to merger of pay scales they are receiving pay virtually in the same scale in which they were initially appointed.
2.However, the benefit of ACP is to be granted in the pay scale of promotional hierarchy of the particular cadre of employees on fulfilment of promotional norms, the residency period in the lower post as provided in the RR for promotional movement of the respective cadre is not applicable for the grant of ACP up-gradation as per clarification no.14 of the above quoted DOPT order dated 10.02.2000.
3.For the erstwhile Group-D employees, designated now as MTS and places as Group C, the hierarchical movement should ensure promotion to the post of LDC, UDC etc. In the existing RR (prior to 6 CPC), the essential qualification for the post of LDC is matriculate with requisite typewriting speed to be acquired before or after appointment. After 6 CPC the minimum qualification for MTS post has been laid down as matriculate. Further as per DOPT order bearing No. AB-14017/32/2009-Estt (RR) dated 07.10.2009, issued in publication of model RR for LDC, the minimum educational qualification for Direct Recruit LDCs has been revised to 12th class. It also contains a provision for filling up 5% of vacancies from Group-C employees who have 3 years regular service in posts with Grade Pay of Rs. 1800 (i.e. the Grade Pay for the post of MTS). Thus the revised RR, as published by the DOP & T contains the provision for the Group ‘C’ MTS employees in the grade pay of Rs. 1800/- to be promoted to the grade of LDC or in other words hierarchical movement of the MTS to the post of LDC has been accepted in the revised RR. Again, for movement to UDC there is no provision for acquiring further educational qualification but a residency period for serving LDCs to become eligible for promotion to the post of UDC nos. been prescribed. Therefore, subject to availability of vacancies, all MTS are eligible for promotion to LDC & UDC grades after fulfilling the required residency period as prescribed in the RR. But as per clarification issued against point no. 14 of DOPT order dated 10.02.2000 the residency period is not to be taken into consideration for extending the benefit of ACP.
4.The existing MTS comprises of having requisite qualification of matriculation and some non matriculates who have already been imparted with the requisite training to make them at par with matriculates as per conditions of 6 CPC order to enable them to be placed in the regular Grade Pay of Rs. 1800/- in PB-I and once they were placed in PB-I with Grade pay of Rs.1800/- in the Group ‘C’ cadre they became part of the hierarchy of the Group ‘C’ as the model RR, as published by the DOP&T dated 07-10-2009 contains the clause for hierarchical movement of such Group ‘C’ employees who are employed in posts with Grade pay of Rs.1800/-.
5.Therefore, this office is of the view that all these employees now designated as MTS are having requisite qualification for promotion to the posts of LDC and UDC subject to availability of vacancy and satisfaction of promotional norms for the post. Hence, those MTS who had already completed 24 years of service up to 31-08-2008 are entitled to get two financial up-gradations in the Grade pay of 1900/- (LDC) and 2400/- (UDC) in the hierarchy of the Group’C’ cadre as residency period is not to be taken into consideration for extension of the benefit of ACP and all previous up-gradations/promotions granted to them stand merged w.e.f. 1.1.2006 resulting which they are virtually in receipt of the pay attached to the post of that initial appointment.
6.However, HQrs office on the same issue related to MTS of the DAD replied to the staff associations at JCM-III council meeting held on 30-05-2013 that the issue has amply been clarified in the OM bearing No. F No. 1/1/2008-IC dated 24-12-2008, issued by the Ministry of Finance, Department of Expenditure implementation Cell. In this connection it may be mentioned that in the ibid order the Ministry reiterated that all eligible Group-‘D’ employees should be granted GP of Rs.1800 in PB-1 irrespective of their erstwhile Group-‘D’ pay scale whether granted on regular appointment/promotion or under ACP.
7.In this context it may also be mentioned that erstwhile Group ‘D’ employees are appointed in the pre-revised pay scale of Rs.2550-3200/- and could have a maximum movement up to the scale of Rs.2750-4400/-. There was no provision for such Group ‘D’ employees was restricted from the scales of Rs.2550-3200/- to Rs.2750-4400/-. Since, all these scales stand merged in PB-1 with GP-1800 w.e.f. 1.1.2006, the Ministry clarified that all of such Group ‘D’ employees irrespective of their pre-revised scales from Rs.2550-3200 to Rs.2750-4400/- should be placed in the Grade Pay of Rs.1800/- in PB-1. But such placement does not take away their entitlement for ACP in hierarchical structure of Group ‘C’ cadre after the merger and their placement in Group ‘C’ cadre in terms of clarification 1 of ACP orders dated 10.02.2000; if they fulfil all the promotions norms in the changed scenario. In other words, the ibid order of the Ministry of Finance does not issue any clarification on the issue of grant of ACP in between 01-01-2006 to 31-08-2008 for erstwhile Group ‘D’ employees now designated as MTS.
8.As the HQrs office, maintains the view, as examined to JCM members and as conveyed to this office vide No. AN/XI/11051/MACP/2013/Vol-III dated 22-07-2013 which cannot be clearly interpreted as an ascent to grant ACP benefit to such employees, this office is of the view that HQrs office may kindly review the case in the light of the facts, stated above.
9.Since, the Staff Associations of various Ordnance Factories and the OFB authorities are pressing hard for grant of ACP up-gradation to these employees, an early clarificatory order on the above issue from the HQrs office will enable this office to take a considerate decision in this regard.

Dear Comrades, 
            Confederation of Central Govt. Employees’ and Workers Associations has declared 48 hours nationwide strike of Central Government Employees on 12th &13th February, 2014 demanding settlement of 15 point Charter of Demands including DA Merger, Interim Relief, Inclusion of Gramin Dak Sewaks in 7th CPC, Regularization & Revision of wages for casual labourers, Date of effect of 7th CPC as 01.01.2014. Rescind the PFRDA Act etc.

In first phase agitation programme a mass Dharna was organized at Jantar Mantar, New Delhi on 9th January, 2014 in pursuance of 15 point charter of demands.  The Dharna was inaugurated by Com. S. K. Vyas,  Adviser, Confederation  & Com. K. K. N. Kutty, President of Confederation presided over the meeting. The Secretariat Members who took part in the Dharna programme met in an emergent meeting where more than 90% is reported to have voted in favour of Strike.

            Further, as per a judgment delivered in Nagpur High court case, it was declared in the High court that when an elevation of post occurs due to cadre restructuring (as done from 01.04.1987) the elevation from Accountant to Sr. Accountant, given to an employee due to the policy of that cadre restructure, should not be considered as promotion.
            Also, as per the judgment given in respect of the case of one Accounts Assistant from Southern Railway, Chennai, the judgment was delivered in all the levels, namely, CAT, CHENNAI, HIGHCOURT CHENNAI AND SUPREME COURT, ND, the contention of the employee that elevation of post from Accountant to Sr. Accountant, done due to policy change or cadre restructure done in organised Accounting Cadre, is not to be considered as promotion at all. In addition, the DAD employees have been facing trouble due to non-redressal of their grievances mentioned in Part-III.
Considering the circumstances stated above and being an affiliated unit of Confederation as well as a responsible organization this Association have no alternative but to go for Strike to achieve our following Charter of Demands. Accordingly, the NOTICE for Strike has been served to the CGDA, New Delhi on 23.01.2014.


All CEC members & Office bearers, DADCCs and Branch units are requested to
bring the contents of the circular to the knowledge of all members and organize them in the strike called for on 12th & 13th February, 2014 to make it a grand success. It is also requested to visit the website of this Association in regular manner for updated development.

      CHARTER OF DEMANDS
PART- I
1.   Accept the terms of reference of 7th CPC, submitted by the staff side, National Council JCM.
(a)  To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefits like Pension, Gratuity and other terminal benefits of various categories of Central Government Employees including Gramin Dak Sevaks (GDS) of Postal Department.
(b) To work out the comprehensive revised pay packet for the categories of Central Government employees including GDS as on 1.1.2014.
(c)  The Commission shall determine the pay structure, benefits, facilities, retirement benefits etc. taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honorable Supreme Court there-on, as on 1.1.2014.
(d)  To determine the Interim Relief needed to be sanctioned immediately to the Central Government employees including GDS.
(e)  To determine the percentage of Dearness allowance/Dearness Relief immediately to be merged with Pay and pension including GDS.
(f)  To settle the anomalies rose in various forum of JCM.
(g)   To work out the improvements needed to the existing  retirement benefits, like pension, death cum retirement gratuity, family  pension and other terminal or recurring  benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered service on or after 1.1.2004.
(h)  To recommend methods for providing cashless/hassle-free Medicare facilities to the employees and Pensioners including Postal pensioners.
2.    Ensure every five year revision of wages of Central Government Employees in future.
3.   (a) Regularization of Gramin Dak Sevaks of the Postal Department and grant of Civil Servant status, statutory pension and all other benefits at par with regular employees. (b)  Regularization and revision of wages of casual and contract workers.
4.   Compassionate appointment – removal of restrictions imposed by Government.
5.  JCM and Anomaly Committee Functioning.
6.  Fill up all vacant posts and creation of new posts wherever justified.
7.  Stop downsizing, outsourcing, contractorisation and privatization of Government functions.
8.  Stop the move to introduce performance related Pay (PRP) system, Extend PLB Bonus for all, removing bonus ceiling.
9.   Revise OTA and Night Duty Allowance rates and clothing rates.
10. Implement arbitration awards.
11. Five promotions to all.
12. Rescind the PFRDA Act. Ensure statutory Pension for all.
13. Stop price rise. Revive and extend public distribution system for all.
14. Stop trade Union victimization.
15.  Ensure Right to strike.
PART II
1.      Pay arrears of Pay from 1st Jan 1996 to 18th Feb 2003 as directed by Courts to audit & accounts cadres.
2.     i) Upgrade LDC as Audit/Accounts Assistant and merge Auditor/Accountant and SA
ii) Grant the following pay scales to Audit & Accounts Cadres
            Audit/Accounts Asstt.  - GP 2400, PB 1
            SA                              - GP 4600, PB2
            AAO                            - GP 5400, PB2
            AO                              - GP 6600, PB3
            SAO                            - GP 7600, PB4
iii) Grant MACP on departmental hierarchy basis
iv) Grant one increment and Grade pay of Rs 5400 from the day of passing AAO/SOG examination.
v) Grant three increments on passing departmental confirmatory examination.

PART III
1. Similar Pay for Promotee & Direct recruits i.e Entry Pay.
2.Extension of benefit of entry pay for all AAOs in the light of Allahabad High  
   Court judgemant.
3. Grant of 1stACP(Gr. Pay-Rs.1900) and 2nd ACP (Gr.Pay Rs.2800) to erstwhile Gr-D(MTS) who have completed 12yrs. and 24 yrs. during 01.01.2006 to 31.08.2008.
4. Promotion of all MTS (erstwhile Group-D) to the grade of Clerk irrespective of       Qualification as an one time measure.
5. Recruitment and promotion of Canteen employees.
6. Compassionate appointments of all left out cases.
7.Promotion of Clerk to Auditor and Auditor to Sr. Auditor after completion  5 and 3 years regular services respectively.
8.  Extension of MACP benefit on hierarchy of promotional post of concerned department.
9. Implementation of Court order towards payment of arrear from 01.01.1996 to  
    18.02.2003 in connection with pay parity with the Central Secretariat.

You are requested to start campaign to ensure grand success nationwide Strike scheduled on 12th and 13th February, 2014 to achieve the charter of demands mentioned above.

Expected Merger of 50% DA

Merger of 50 percent DA may soon be considered by Central Government –Sources

Sources close to the Central Government Employees Federations told that Merger of 50% DA will soon be considered by Central Government before the budget session of Parliament in February 2014. According to the sources, the central government is likely to consider the central government employees  demand for merging of 50 % DA, for the reason that the DA will be crossing 100% level after January 2014.

The rate of dearness allowance to be paid to govt servants has been increasing consistently due to the rise in the prices of essential commodities for the past two years. In 2011 the rate of DA was at 50 % level. Since then all the Federation demanded the central government to merge the 50 Percent DA with basic Pay. But the government did not accept this demand to merge the DA with basis pay, as it was not recommended by sixth CPC.

The demand would be considered in view of parliament elections

But federations kept on demanding the government that raising dearness allowance alone will not help to compensate the alarming rate of price rice. So they urged the government to consider their demand favorably. It is believed that after the defeat in the election of four state legislative councils, the UPA government has decided to reconsider about its decision on the issues which directly affects the common public. The high command of the ruling party thought that the reason for their defeat in the state election is mainly because of their government failed to contain the price rise. The gap between common public and UPA government has been considerably increased. To correct these failures the UPA government decides to do something to attract the voters.
After announcing the government’s proposal to constitute the 7th pay commission, the community of central government employees has been convinced to have soft view on this government. Further the 50 lakh central government employees would be made happy if the 50% DA is merged with Basic Pay. It is told that , as the central government staff association and federations demanding it very seriously, in case the government decides go with this demand, there will be around one crore voters will be in favour of UPA government. So the government may consider the demand of merging of 50% DA with basic Pay in view of forthcoming Parliament elections.

Allowances will have no impact on merging DA with basic Pay

The sources, associated with National Council JCM, said that the government initially was not willing to consider this demand as some allowance and advances have been raised by 25% whenever the DA crosses 50% level as per the sixth CPC recommendation. But federations insisted that the allowances, which are raised to 25 % level when DA crosses 50%, will have no impact on merging DA with basic pay. The only allowance will have an increase when Basic Pay increases are HRA. No other allowances will be increased and other entitlement of the respective Grade Pay will not be revised as the 50% DA to be merged will be kept under separate component like it was treated in 5CPC as Dearness Pay. “There is no need to worry about financial implications, as the 50% DA will be paid by just changing its nomenclature as Dearness Pay”, said sources.

50% DA merger to be decalered before DA crosses 100%

Further, it has been informed that it is good enough for the government to announce its decision before declaring the next additional installment of DA. Because the AICPIN for Industrial workers for the Month of December 2013 is awaited to determine the rate of dearness allowance to be paid from January 2014.The result of last 11 months AICPIN shows that DA will definitely be raised by 10 % from existing 90% level. So the rate of DA will be 100% with effect from 1st January 2014. After the DA increased to 100%, the demand for 50% DA merger will have to change its avatar. Probably the demand would be for 100% DA merger. So the federations expect the government may consider 50% DA merger soon.
However, decision if any in this regard should be taken before the announcement of election for parliament. It is expected that election announcement for parliament will be made by the end of February 2014. Before that,  the announcement of 50% DA merger is expected from central government.

Sub: Non-receipt of Minutes of the Meeting over Draft Transfer Policy

Respected Madam,

I am to inform you that the Minutes of the Meeting for discussion over Draft Transfer Policy held on 07.11.2013 is still awaited. In addition, this Association has given some logic/clarification in support of Para-2 and 12 vide even No. dated 29.11.2013. This Association is in dark about the status Proposed Transfer Policy till date. It is urged upon the authority kindly supply/forward the said minutes of the said meeting at the earliest for appraisal and to communicate views of this Association before finalization of the same. 

 I am directed to state that a meeting may kindly be arranged on the previous day of ensuing 44th Main Meeting for finalization of Draft Transfer Policy and then the same may be incorporated in OM Part-I. Otherwise, any amendment concerned para(s) of OM Part-I will be treated as unilateral decision of HQr Office.
