MACP on Hierarchy

The Principal CAT [OA 904/2012 dt. 26-11-12], Delhi and Punjab & Haryana High Court [CWP No. 19387 of 2011 (O&M) Decision dated 19.10.2011 have held that MACP is to be granted on promotional hierarchy and not on next higher Grade Pay as per the 6th Pay Commission Recommendation. The SLP filed by Union of India against the P&H decision was dismissed by the Supreme Court [CC 7467/2013]

Dear Comrade,
Confederation vide their Circular no. 5/2013 of 12.9.2013 intimated to hold STRIKE BALLOT on 11, 12 & 13th November, 2013  in lieu of 25,26 & 27th  September 2013 as a final step before embarking upon a nationwide indefinite strike.  Being affiliate of the confederation AIDAEA (HQ)we are committed to make the programme all success in our Branch Associations over the country.  Sample Ballot paper is shown below:-

Please translate the appeal and charter of demands into local language and distribute it to each and every employee before 9th November, 2013.  On 11th, 12th and 13th November, 2013 POLLING BOOTHS may be opened in the premises of offices at all centers and ballot boxes may be placed in the booth.  Each and every employee may be requested to cast their vote in the ballot paper by marking “YES” or “NO”.  It is secret ballot and hence name of the employee shall not be written in the ballot paper.  On completion of the voting, the boxes may be opened and votes counted by the office bearers of the affiliated organisations.  Total number of employees voted, number of votes in favour of indefinite strike (YES), Number of votes against indefinite strike (NO), Invalid votes etc. should be intimated to the undersigned on or before 14th November 2013 by email: (Email ID: aidaeakol@gmail.com
               Intensive campaign among the employees should be conducted before the strike ballot by organising squad work, distributing pamplets, sample ballot papers, appeals, posters etc. and also by arranging meeting at all centres and offices.

15  Charter of Demands
1)  Revise the wages of central Govt. employees including Gramin Dak Sewaks w.e.f 1.1.11 and every 5 years thereafter setting 7 CPC.
2)  Merge DA with pay for all purposes w.e.f 1.1.11 including Gramin Dak Sewaks.
3)  Remove restriction imposed on Compassionate appointments and the discrimination on such appointments and the3 discrimination on such appointments between the Railway workers and other central govt. employees.
4)  (a) Departmentalise all Gramin sewaks and grant them all benefits of regular employees; End Bonus discrimination and enhance Bonus ceiling to 3500/-, withdraw open market recruitment in Postman/MTS cadre; Revise cash handling norms; Grant full protection of TRCA; Grant Full time bound promotion and Medical reimbursement facility etc. (b) Regularise Daily rated, Contingent and Casual workers and introduce a permanent scheme for periodical regularisation, pending regularisation, provide with pro-rata salary at 6 CPC rates.
5)  (a) Revive the functioning of JCM, Convene the meeting of Departmental Councils in all Ministries/Departments. Settle the anomalies raised in National Anomaly Committee as also in the Departmental Anomaly Committees. Hold National council meetings as specified in the JCM constitution. (b) Remove the anomalies in the MACP scheme. (c) Grant recognition of all Associations/Federations which have complied with the formalities and conditions stipulated in the CCA (Rules).
6)   Fill up all vacant posts and create post on functional requirements.
7)      Stop downsizing, outsourcing, contractorisation, corporation and privatisation of Govt. functions.
8)       (a) Stop the proposal to introduce the productivity linked waged system. (b) Discard performance related pay structure. (c) Introduce PLB in all Departments. (d) Remove the Ceiling on emoluments for bonus computation.
9)      Revise the OTA, Night Duty Allowance and clothing rate.
10)  Implement all Arbitration awards.
11)  Give Five promotions to all the employees as is provided in Group-A services.
12)  (a) Withdraw the PFRDA Bill (b) Rescind the decision to allow FDI in pension sector. (c) Scrap the new Contributory pension scheme. (d) Extend the existing statutory defined pension scheme to all central govt. employees irrespective of their date of entry in Govt. service.
13)  Stop price rise, strengthen public distribution system.
14)  Vacate all Trade union victimisation. Ensure Trade Union democratic rights.
15)  Ensure right to strike as legal right by enacting law.
